Terms of Service

1. Acceptance of Terms

Welcome to TheLineageApp ("App," "Platform," "Service"), operated by The Lineage Project LLC, a Delaware limited liability company ("Company," "we," "us," or "our").

By accessing or using TheLineageApp, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms. We will notify you of material changes via email or in-app notification.

2. Eligibility and Age Requirements

2.1 Age Restriction

You must be at least 18 years of age to create an account and use TheLineageApp. By creating an account, you represent and warrant that you are at least 18 years old.

2.2 Family Content Clarification

While account holders must be 18+, users may include family members of all ages in their family trees, memorials, stories, and other content. Parents and legal guardians are responsible for all content posted about or including minors.

2.3 Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials, all activities that occur under your account, ensuring your account information is accurate and current, and notifying us immediately of any unauthorized use.

3. User-Generated Content

3.1 Content You Provide

TheLineageApp allows you to create, upload, post, and share content including family tree information, photographs and videos, voice recordings, written stories and memories, memorial tributes, and messages.

3.2 Content Ownership and License

3.3 Content Shared with Family Members

When you invite family members to your family tree or share content with them, they receive access to all content you have shared, may copy or save that content for personal use, inherit shared family tree information, and you cannot revoke their access to content they have already saved.

3.4 Content Restrictions

You agree NOT to upload, post, or transmit any content that violates any law, infringes on intellectual property or privacy rights, contains hate speech or harassment, contains explicit sexual content, exploits or endangers minors, contains malware, impersonates any person, or violates our Community Guidelines.

3.5 Content Backup and Loss

While we implement reasonable backup procedures, we are not responsible for loss, corruption, or deletion of your content. You are solely responsible for maintaining backup copies of your content.

4. Privacy and Data Protection

Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference.

5. Family Tree Inheritance System

5.1 How Inheritance Works

When you invite a family member to join your family tree, they automatically receive access to the family tree you have built, inherit all family member profiles and relationships, and can add to the tree but cannot delete profiles you created.

5.2 Disputes Over Family Information

If family members disagree about information in shared family trees, each member can maintain their own version of disputed information. We do not mediate family disputes or determine factual accuracy.

6. Subscription and Payment Terms

6.1 Free Tier

TheLineageApp offers a free tier with basic features including basic family tree building, limited memorial creation, basic story posting, and limited storage capacity.

6.2 Premium Features

Premium subscriptions may include unlimited family tree members, advanced memorial features, unlimited storage, voice recording features, priority customer support, and export tools.

6.3 Payment and Cancellation

All payments are processed through secure third-party processors. Subscriptions automatically renew unless cancelled before the renewal date. You may cancel at any time through your account settings. Cancellation takes effect at the end of the current billing period. Subscription fees are non-refundable except as required by law.

7. Prohibited Conduct

You agree NOT to use the Service for any illegal purpose, impersonate any person or entity, harass or harm other users, attempt to gain unauthorized access to our systems, interfere with or disrupt the Service, use automated systems without permission, reverse engineer our software, collect information about other users without consent, or sell or transfer your account.

8. Intellectual Property

The Service, including all software, text, images, graphics, user interfaces, trademarks, and logos (excluding user-generated content) is owned by The Lineage Project LLC and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes.

9. Termination

9.1 Termination by You

You may terminate your account at any time by using the account deletion feature or contacting support@thelineageproject.com. Upon termination, your account will be deactivated, your content will be removed from public view, but content shared with family members may remain visible to them.

9.2 Termination by Us

We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent or illegal activity, or your use poses a security or legal risk.

10. Disclaimers and Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation.

We do not verify the accuracy of user-generated family information and are not responsible for errors or omissions. You are solely responsible for maintaining backups of your content.

11. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or content, resulting from your use or inability to use the Service.

Our total liability to you for all claims shall not exceed the greater of the amount you paid us in the twelve months preceding the claim, or $100.

12. Indemnification

You agree to indemnify, defend, and hold harmless The Lineage Project LLC, its officers, directors, employees, and agents from any claims, liabilities, damages, or expenses arising from your use of the Service, violation of these Terms, violation of any rights of another party, or content you submit.

13. Dispute Resolution and Arbitration

13.1 Informal Resolution

Before filing a claim, you agree to contact us at legal@thelineageproject.com to attempt to resolve the dispute informally within 60 days.

13.2 Binding Arbitration

If we cannot resolve the dispute informally, any dispute shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, conducted in Dallas, Texas.

13.4 Opt-Out Right

You may opt out of this arbitration agreement by sending written notice to legal@thelineageproject.com within 30 days of first accepting these Terms.

14. Governing Law and Venue

These Terms shall be governed by the laws of the State of Delaware. For disputes not subject to arbitration, you agree to submit to the exclusive jurisdiction of the state and federal courts located in Dallas County, Texas.

15. Additional Provisions

These Terms, together with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and The Lineage Project LLC regarding the Service. If any provision is found invalid, the remaining provisions remain in full force.
